As mentioned in the first series of this webinar, the PERM Labor Certification Process is a multi-step procedure that a U.S. employer must follow to sponsor an immigrant worker for lawful permanent residence. When a U.S. employer files an ETA Form 9089, the Department of Labor can approve, deny, or audit your PERM. If your PERM is approved, the U.S. employer must then proceed to the second major step of the process, which is successfully filing Form I-140 with USCIS. While an employer may think that it survived the most difficult part of the process by having their PERM approved, an employer still needs to be careful and avoid making any untimely or careless mistakes during this second stage that could jeopardize their petition and result in a denial.
